Scotland mandates EIAs for large data centres

Scotland will require EIAs for data centres above 50MW capacity. The direction takes effect on 17 September and formalises environmental scrutiny for major proposals.

The Scottish Government has introduced a planning direction requiring an Environmental Impact Assessment for every new data centre in Scotland with power capacity above 50MW.

The Town and Country Planning (Environmental Impact Assessment) (Data Centres exceeding 50MW Power Capacity) (Scotland) Direction 2026 comes into force on 17 September. It applies to qualifying industrial estate or urban development projects where the proposed data centre exceeds the stated electrical capacity threshold.

The measure follows a separate August direction requiring planning authorities to notify Scottish Ministers within seven days of validating applications for data centres above 50MW. That earlier requirement gave ministers strategic visibility of the development pipeline; the new direction makes an EIA compulsory for developments that meet the threshold.

Projects below 50MW remain within the existing screening regime. Planning authorities will continue to decide whether an EIA is required under the Town and Country Planning (Environmental Impact Assessment) (Scotland) Regulations 2017, based on the characteristics, location and likely effects of each proposal.

The 50MW threshold is defined by the total proposed electrical power available to the data centre rather than its floor area. A relatively compact building can therefore enter the mandatory EIA regime if its electrical demand is sufficiently high, bringing power infrastructure and planning requirements together at an earlier point in development.

Large data centres can require substantial grid connections, substations, standby generation, cooling equipment, water infrastructure and extensive mechanical and electrical installations. The environmental work supporting an application may consequently extend well beyond the main building, particularly where new electrical compounds, access roads or utility connections are required.

The Scottish Government identifies energy consumption, water use, greenhouse-gas emissions, landscape effects, biodiversity, soils, water resources, noise and air quality among the issues that may require assessment. Backup generators and other fossil-fuelled equipment may introduce additional emissions considerations, while the location and scale of a scheme can affect the level of mitigation needed.

An EIA does not determine whether planning permission should be granted. It establishes the likely significant environmental effects of a development and the mitigation proposed to address them, giving the planning authority a formal evidence base for its decision.

Developers will now need to programme environmental studies into qualifying projects from the outset. Surveys, modelling and mitigation work can influence site layout, drainage, access, cooling strategy, acoustic treatment and the positioning of high-voltage equipment before detailed design and procurement are fixed.

That earlier commitment of design information can reduce the scope for major changes later in the programme. Altering a substation compound, generator arrangement, cooling system or access route after specialist packages have been procured can affect civils, structure, services coordination and construction sequencing at the same time.

The direction also places greater emphasis on the relationship between planning and grid delivery. Data-centre schemes can carry significant electrical demand before construction begins, and connection requirements often influence land take, phasing and infrastructure design. Treating power capacity as the trigger therefore captures projects whose environmental footprint may be driven as much by their supporting infrastructure as by the data halls themselves.

Scotland had already moved towards closer oversight of major data-centre proposals through the August ministerial-notification direction. The September measure establishes a consistent environmental requirement across qualifying developments rather than relying on individual screening decisions.

For contractors, the most immediate effect will be felt before mobilisation. The construction methods used after consent are unchanged, but programme certainty will depend on planning, environmental mitigation, utilities and grid infrastructure being sufficiently resolved before major work packages are released.

The Direction will be reviewed periodically as data-centre technology develops. Changes in computing density, cooling systems, energy efficiency and power demand could alter the environmental profile of future facilities, but the current threshold now creates a clear procedural line for the largest projects.

From 17 September, any new Scottish data centre above 50MW that falls within the qualifying development classes will enter the EIA process automatically, making environmental assessment a defined early-stage requirement rather than a question to be settled later in planning.
