Scotland tightens oversight of major data centres

Scotland will monitor major data-centre proposals from planning validation onwards. Authorities must notify ministers within seven days for developments above 50MW.

The Scottish Government has introduced a planning direction requiring authorities to notify ministers within seven days when they validate applications for data centres with power capacity above 50MW, giving central government earlier oversight of projects with potentially substantial infrastructure demands.

The direction took effect on 17 August and is intended to provide strategic visibility of Scotland’s data-centre pipeline. It does not automatically transfer every qualifying application to ministers, but it creates a formal early notification point from which the government can monitor proposals and decide whether further intervention is warranted.

Ministers have simultaneously acted on three individual projects. A planning appeal for a proposed green data centre at Redheughs Avenue in Edinburgh has been recalled for ministerial decision, while Environmental Impact Assessments have been required for proposed data-centre locations at Wester Hermiston in Edinburgh and Auchtertool in Fife.

Those cases show why data centres are moving into a more strategic planning category. A large facility is not simply an industrial shell filled with computing equipment; it can require substantial grid capacity, substations, backup generation, cooling, water infrastructure, fibre connectivity, security systems, highway access, and enabling works before the server halls themselves become operational.

The 50MW threshold is therefore more closely related to infrastructure intensity than building size. Projects above that level can create material electricity demand and may need network reinforcement or dedicated connection assets whose programme extends beyond the construction of the main building.

For developers, the seven-day notification rule introduces another defined step immediately after validation. Its practical effect will depend on how often ministers use that early visibility to intervene, but major applicants now have less reason to assume that central-government scrutiny will arise only late in the planning process.

That should increase the value of resolving power and infrastructure assumptions before submission. Data-centre programmes commonly run several parallel workstreams across planning, grid connection, civils, utilities, shell-and-core design, mechanical and electrical systems, and specialist fit-out, with the critical path capable of shifting between them as technical constraints emerge.

A planning consent for the building is of limited use if the required electrical capacity cannot be connected on the same programme. Conversely, a secured grid position does not eliminate environmental, transport, drainage, landscape, noise, or community issues that may still prevent the site from being consented.

The requirement for Environmental Impact Assessments at Wester Hermiston and Auchtertool illustrates the breadth of evidence that may be expected from larger proposals. Depending on the site, an EIA can require coordinated assessment of transport, ecology, landscape, noise, water, drainage, energy, cumulative impacts, and construction effects.

That work adds time and cost before procurement, but it can also reduce downstream uncertainty if technical constraints are identified before a contractor is asked to price the main works. Late changes to power compounds, access roads, drainage infrastructure, acoustic treatment, or building layout are considerably more expensive once design packages have been released.

The Scottish Government has also linked its approach to community wealth building and the wider economic benefits expected from major digital infrastructure. That is likely to sharpen attention on local employment, procurement, infrastructure contributions, and potentially heat-reuse or energy-efficiency measures, although requirements will remain scheme-specific.

For contractors, the development opportunity remains substantial. Large data centres can create workload across earthworks, piling, concrete, steelwork, envelopes, high-voltage systems, cooling, fire protection, controls, standby power, security, and specialist fit-out, often on accelerated programmes with unusually high demands on building services.

The constraint is that the supporting infrastructure has to be credible before those packages become secure workload. A project whose grid connection depends on reinforcement several years away may have planning permission but still be unable to move into full construction, while a site with available power can remain blocked by local planning or environmental conditions.

Scotland’s new direction does not create a blanket call-in policy. Local planning authorities remain responsible for applications unless ministers exercise existing powers in a specific case, as they have done with the Redheughs Avenue appeal.

That distinction limits the procedural burden while giving government early sight of every large proposal. Developers above the threshold now know that ministerial interest is possible from the first week of a valid application, which puts more weight on the quality of infrastructure, environmental, and community evidence submitted at the outset.

Data centres are increasingly forcing planning systems to treat digital growth as a physical-infrastructure issue. The new Scottish direction recognises that a 50MW-plus project can have consequences well outside its red-line boundary, and the next test will be whether earlier government oversight improves coordination or simply adds another layer to an already complex consent and power-delivery programme.
